Any signage, including political signs are not permitted in our community, except “For Sale or Rent” signs. It is important that our residents are given the correct information on this rule to avoid any confusion.
The Planned Community Act (PCA), KRS 381.00 does not apply to our community association.
KRS 381.786(1) provides in part, “Unless specifically stated, nothing in KRS 381.785 to 381.801 shall invalidate any provision of a document that governs a planned community if that provision was in the document at the time the document was recorded and the document was adopted or recorded prior to June 29, 2023.”
The Declarations for Plainview Residents Association were recorded prior to June 23, 2023. The Declaration of Covenants, Conditions and Restrictions for Plainview states, “No sign for advertising or for any other purpose shall be displayed on any lot or on a building or a structure on any lot, except one sign for the advertising the sale or rent……”
Therefore, KRS 381.800 is not applicable per KRS 381.786(1).
When a homeowner purchases a home in a deed restricted community he/she agrees to abide by the association’s covenants and rules. So, if the Declaration of Covenants, Conditions and Restrictions prohibits all signs except for a “for sale/lease” sign, then the homeowners must comply.
When there is a violation, the Board of Directors sends a violation letter. After seven days, a second notice is sent, if the violation has not been corrected.. If the violation still isn’t corrected, it is handed over to the Board’s attorney for further action.
